Website and online service terms

These Terms govern your use of the PowerHouse Exteriors website, Roof Reports, bid reviews, accounts, service-request tools, and related online features.

1. Acceptance and eligibility

By accessing or using the Services, you agree to these Terms and acknowledge our Privacy Notice. If you do not agree, do not use the Services. You must be at least 18 years old and legally able to enter into these Terms. If you use the Services for another person, property owner, or organization, you represent that you have authority to do so and bind that party where applicable.

2. Website information and emergencies

Website content is provided for general informational and planning purposes. We make reasonable efforts to keep it useful and current, but availability, service areas, products, credentials, promotions, pricing, warranties, and other content may change. A written proposal or contract controls if it conflicts with the website.

The website and online forms are not emergency services. If there is an immediate threat to life or safety, contact emergency services. For active water entry, exposed property, downed utilities, or unstable materials, avoid unsafe areas and call an appropriate emergency provider. You may also call PowerHouse at 208.830.5823, but we do not guarantee emergency availability or response time.

3. Roof Reports, bid reviews, estimates, and property data

Roof Reports, bid comparisons, weather context, storm indicators, aerial measurements, property facts, scoring, cost ranges, and other automated or online outputs are preliminary planning aids. They may rely on public records, third-party data, imagery, algorithms, assumptions, and information you provide. Any source may be incomplete, outdated, unavailable, or inaccurate.

These outputs are not a physical inspection, measurement certification, engineering or architectural opinion, appraisal, code determination, environmental assessment, insurer or claim decision, legal or tax advice, financial advice, or promise that work is necessary, feasible, covered, or eligible for a permit. They are not a warranty of present or future roof performance.

Do not delay urgent maintenance or rely on an online output as the sole basis for a purchase, repair, insurance, safety, or financial decision. Final scope, measurements, materials, pricing, schedule, and warranties require an appropriate on-site evaluation and a separate signed written agreement.

4. Service requests, scheduling, and project agreements

Submitting a form asks us to respond about the selected service. It does not require you to buy, require us to accept a project, reserve a schedule, establish an insurer relationship, or create a construction contract. Appointment times, response times, availability, and preliminary pricing are not guaranteed until confirmed by us.

Any actual work is governed by a separate written proposal or construction agreement covering items such as scope, price, payment, schedule, materials, permits, warranties, exclusions, cancellation rights, and change procedures. These Terms govern only the website and related online tools unless that separate agreement expressly says otherwise. Nothing in these Terms limits a non-waivable consumer right or remedy.

5. Accounts, verification, and access links

You are responsible for access to the email account used to verify your account and for activity occurring through your authenticated session. Verification codes are personal and may expire. Do not share a code or leave an authenticated device accessible to others. Notify us if you suspect unauthorized access.

Some reports and bid reviews are available through a unique link. Anyone with the link may be able to view the linked content. Keep these links confidential and share them only with people authorized to see the information. We may expire, disable, or replace a link for security, operational, or legal reasons.

6. Files and other content you submit

You retain any ownership you have in documents, photos, text, and other content you submit (“User Content”). You represent that the content is accurate to the best of your knowledge, that you own it or have permission to provide it, and that our use as described here will not violate another person's rights or any duty of confidentiality.

You grant PowerHouse and its service providers a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, extract, format, and analyze User Content only as reasonably necessary to operate, secure, support, and improve the requested Service, communicate with you, and comply with law. This license ends when the content is deleted from active systems, except for retained backups, legal records, or de-identified information.

Do not submit malware, unlawful material, content you are not authorized to share, or sensitive data that is unnecessary for the Service. Before uploading an estimate, redact Social Security numbers, bank or payment card details, dates of birth, medical information, passwords, and access credentials.

7. Calls, emails, and text messages

When you provide contact information and request a report or service, you authorize PowerHouse and providers acting for us to send operational calls, emails, or texts reasonably related to that request. Consent to optional marketing or automated promotional texts is separate and is not a condition of purchase.

Message frequency varies and message and data rates may apply. Reply STOP to opt out of text messages and HELP for help. Use the unsubscribe link in a marketing email where provided. An opt-out may generate one confirmation message and does not prevent communications required to complete an existing transaction, address security or safety, or comply with law.

8. Acceptable use

You may use the Services only for lawful, personal, and legitimate business purposes. You may not:

  • Misrepresent your identity, authority, property interest, or the accuracy or source of submitted information.
  • Upload malicious code, probe security, bypass access controls, or disrupt the Services or another user.
  • Use bots, scraping, bulk requests, or automated means except with our prior written permission.
  • Copy, resell, frame, reverse engineer, or commercially exploit the Services or their outputs.
  • Use the Services to harass, deceive, violate law, infringe rights, or solicit unrelated third parties.
  • Attempt to access another person's account, report, bid review, or non-public information.

We may investigate suspected misuse and restrict, suspend, or terminate access when reasonably necessary to protect the Services, users, or others, or to comply with law.

9. PowerHouse content and limited license

The Services, including their design, software, text, graphics, branding, compilation, and original outputs, are owned by or licensed to PowerHouse and are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services and download a report made available to you for your personal, non-commercial evaluation of a property or project. No other right or license is granted.

If you provide feedback, you authorize us to use it without restriction or compensation, provided we do not identify you publicly without permission.

10. Third-party services, data, and links

The Services may rely on or link to third-party mapping, parcel, imagery, permit, weather, analytics, communications, and other providers. Third-party services and data are governed by their own terms and policies. We do not control and are not responsible for their availability, accuracy, security, or content. A link or integration does not imply endorsement. Your use of a third-party destination is at your own risk.

Our Privacy Notice explains how we handle personal information in connection with the Services and is incorporated into these Terms.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL ONLINE CONTENT, REPORTS, DATA, ESTIMATES, AND OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” POWERHOUSE DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES RELATING TO THE SERVICES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AVAILABILITY, SECURITY, AND RESULTS.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY REPORT, ESTIMATE, PUBLIC RECORD, WEATHER EVENT, PROPERTY CHARACTERISTIC, OR THIRD-PARTY DATA WILL BE ACCURATE OR COMPLETE. Some jurisdictions do not allow certain disclaimers, so some of this section may not apply to you.

12. Limitation of liability and indemnity

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POWERHOUSE AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, USE, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATING TO THE SERVICES, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID POWERHOUSE FOR THE SPECIFIC ONLINE SERVICE GIVING RISE TO THE CLAIM DURING THE SIX MONTHS BEFORE THE EVENT, OR (B) $100.

These limitations do not apply to liability that cannot legally be limited, including where applicable liability for gross negligence, willful misconduct, or personal injury caused by a party's negligence. They do not alter liability or remedies under a separately signed construction agreement.

Indemnity

To the extent permitted by law, you will defend, indemnify, and hold harmless PowerHouse and its owners, employees, and contractors from third-party claims, damages, and reasonable costs arising from your unlawful misuse of the Services, your User Content, or your violation of another person's rights. This obligation does not apply to the extent a claim results from PowerHouse's negligence, willful misconduct, or breach of these Terms.

13. Governing law and disputes

Idaho law governs these Terms, without regard to conflict-of-law rules. Subject to any non-waivable right to bring a claim elsewhere, the state and federal courts located in Ada County, Idaho will have exclusive jurisdiction over disputes arising from these Terms or the Services, and each party consents to that venue. Before filing a claim, we encourage you to contact us so the parties can try to resolve the issue informally.

14. Changes, suspension, and general terms

We may change or discontinue all or part of the Services and may update these Terms. Changes apply when posted, unless a later date is stated or applicable law requires additional notice or consent. Your continued use after an effective date constitutes acceptance of the updated Terms.

If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a business transfer or by operation of law. Headings are for convenience only. These Terms and the Privacy Notice are the entire agreement about the Services, but do not replace a signed project agreement.
